The assumption is real
Adjusters, and sometimes jurors, start from the idea that a rider was speeding or taking a risk. It is rarely stated openly and it shapes the offer.
What answers it
The roadway, the sight lines, the other driver’s movements, and the physical evidence of the collision. Where a driver turned across a rider’s path or changed lanes into one, the geometry usually shows it.
Injuries are different
A rider has no cage. The same impact that dents a car can cause orthopaedic injury, road rash requiring treatment over months, or a head injury. Documentation has to keep pace with treatment.
Helmets
Rules vary by state. Helmet use may become an argument about specific injuries. It does not decide who caused the collision.
