How we work an injury case

Thorough preparation drives relentless advocacy

When you are injured, we take on your case and begin investigating what happened, preserving critical evidence, identifying responsible parties, and documenting your injuries.

At Gagliano Law, we take a personal, aggressive, and strategic approach to every personal injury case. We get to know you, understand how the injury has affected your life, and make sure your story is fully documented, not reduced to a claim number.

Evidence can disappear quickly. Vehicles are repaired, businesses overwrite surveillance footage, witnesses become harder to locate, and important records can become more difficult to obtain. The early work matters. That is why we move quickly, prepare thoroughly, and stay involved from the beginning.

What we handle

Injury and negligence cases

Vehicle damage after a road collision

Car accidents

A collision caused by another driver: running a light or a stop sign, turning across your path, following too closely, or driving distracted. We collect the scene evidence, the vehicle damage, and the medical record that ties your injuries to the crash. Drivers, passengers, and pedestrians all have claims.

Truck and commercial vehicle accidents

A crash involving a tractor-trailer, box truck, work truck, or any vehicle operated for a business. Federal rules require the carrier to keep driver qualification files, hours-of-service logs, maintenance records, and electronic control module data. Those records can be overwritten, so the preservation letter goes out immediately.

Rideshare and delivery vehicle accidents

Crashes involving Uber, Lyft, Amazon, FedEx, UPS, USPS, and other delivery and courier vehicles. Coverage depends on what the driver was doing at that moment, whether they were logged in, carrying a passenger, or on a delivery route, and whether they were an employee or a contractor. We identify every policy that applies before anyone gets to decide it does not.

Nursing home abuse and neglect

Harm to a resident from inadequate care: pressure sores, falls, dehydration, medication errors, unexplained injuries, or a sudden decline nobody explains. The proof is usually in staffing ratios, the care plan, prior complaints, and state inspection history.

Negligent security

An assault or shooting at an apartment complex, parking lot, bar, hotel, or store where the owner failed to provide reasonable security. The question is what the property owner already knew: prior incidents, broken locks, dead cameras, lighting, and whether guards were where they were supposed to be.

Electrocution injuries

Contact with live equipment, unmarked or improperly grounded lines, faulty wiring, or unsafe conditions on a job site or a property. These cases turn on equipment records, maintenance history, and which contractor or utility controlled the site.

Wrongful death

A claim brought when someone is killed by another party’s negligence. Every state limits who may file and how long they have, and those deadlines are strict. We handle the claim so the family can handle everything else.

Slip and fall accidents

A fall caused by a hazard the property owner created or allowed to remain: a wet floor, ice, a broken step, poor lighting, or an obstruction. What matters is the condition, whether the owner had notice of it, and how long it sat there before you fell.

Motorcycle accidents

Riders get blamed before the facts are in, and adjusters lean on that assumption. We document the roadway, the sight lines, and the other driver’s movements so the file answers the assumption before it is made.

Bicycle accidents

Right of way, sight lines, and the driver’s movements, documented before the scene and the bicycle change.

Pedestrian accidents

People struck while walking or crossing. Signals, lighting, and nearby video usually decide these.

Product liability

Injuries from a product that was defectively made, defectively designed, or sold without an adequate warning.

Strategic Representation From the Start

A clear process from first review through resolution

  1. Case evaluation

We review how the injury happened, the harm you suffered, applicable deadlines, available insurance coverage, and the legal issues that may shape your claim.

  2. Investigation and evidence

We work to preserve and gather records, photographs, video, witness information, medical documentation, and other proof of liability and damages.

  3. Demand and negotiation

When the record is ready, we present the claim to the responsible parties and insurers, support the damages sought, and negotiate from a documented position.

  4. Litigation readiness

We prepare with litigation in mind, monitor filing deadlines, evaluate defenses and expert needs, and, when appropriate, pursue the claim in court.

  5. Resolution

We explain any settlement offers, risks, costs, and available paths so you can make an informed decision. No result is guaranteed.
