What this involves
Product cases hold the people who designed, made, or sold something responsible when it hurt the person using it. There are generally three theories: a manufacturing defect, where the item left the line wrong; a design defect, where every unit carries the same danger; and a failure to warn, where the risk was known and not communicated. All three depend on keeping the product itself, exactly as it was after the incident.
What has to be shown
- A product was defective in its manufacture or design, or lacked an adequate warning
- The defect existed when it left the seller’s hands
- The product caused your injury while being used in a reasonably foreseeable way
- You are within the filing deadline that applies to your claim
Whether any of this applies to you depends on your facts, and every case is different.
How we handle it
- We secure the product, the packaging, the manual, and the purchase record, and we do not let anyone alter or discard them
- We trace the chain from manufacturer to distributor to retailer
- We look for recalls, complaint histories, and prior incidents involving the same product
- We involve qualified experts where the defect requires technical proof
- We present the claim and file suit if it is not resolved fairly
Why timing matters
The single most important thing in a product case is the product. Do not return it, repair it, or throw it away, and keep whatever it came with.
Questions people ask
I threw away the box. Is the case over?
No, but keep everything you still have. The product itself matters most.
Does a recall prove my case?
It helps and it is strong evidence, but a recall does not automatically establish that the product caused your specific injury.
Who is responsible, the store or the manufacturer?
Possibly both, along with others in the chain. We identify each of them.
