Personal injury

Slip and fall cases are about notice, not the fall

How long the hazard sat there usually decides the case.

The three questions

What the condition was, how it got there, and how long it was there before you fell. An owner is generally responsible where it created the hazard, knew about it, or should have known.

Where the proof lives

Inspection and cleaning logs, incident reports, prior complaints, and camera footage. All of it is held by the property owner, and camera systems commonly overwrite within days.

Report it, and photograph it

Ask for an incident report and photograph the condition before it is cleaned or repaired, which usually happens immediately after a fall.

Open and obvious is an argument, not an ending

Owners often argue a hazard was plainly visible. Whether that defeats a claim is a fact question and varies by state.
